Omega Tours & Travel Terms & Conditions

(1) Understanding and acceptance of terms

The Customer (“you” or “your”) is deemed to have carefully read, understood and accepted the following terms and conditions, as well as the terms of any Addenda, in which Omega Tours & Travel Pte Ltd (“Company”, “we”, “our” or “us”), which expression shall include its present and subsequent members, employees, servants, helpers, suppliers and/or agents, each of which shall have the benefit of and the right to enforce such terms and conditions.

(2) Amendment of terms and conditions

We may amend these terms and conditions in its sole and absolute discretion with or without prior notice to you, and you shall be bound by such amendment which shall be deemed to be incorporated herein.

(3) Warranty

You warrant that all information you have provided or will provide to us, any entity or authority, whether or not in writing, in respect to your booking for the tour and the tour itself, is and shall remain true and accurate in all respects.

You warrant that you have full authority to submit the Booking Form on behalf of all persons in your group and confirm that all such persons are fully aware of and accept these terms and conditions.

(4) Booking and Deposit

To make a booking, you must submit the Booking Form to us with accurate and complete passport details. To confirm your booking, you need to place a non-refundable deposit as stated in the tour itinerary within 7 days of the receipt of the Booking Form, failing which we reserve the right to treat your booking as withdrawn. This deposit will form part of your final payment.

Payment of the deposit and the confirmation of the booking do not constitute confirmation of the tour. All our tours are subject to the minimum group size (as determined by us) before the tour is confirmed. If the minimum group size is not achieved by the deposit collection due date, we shall be entitled to cancel all bookings for the tour.

(5) Full Payment

We will notify you once your tour has been confirmed. You shall make full payment latest by the tour balance collection due date. In the event we do not receive any payment when due for whatever reason, we reserve the right to cancel your booking immediately, in which case you shall pay the relevant cancellation fees set out under clause 8.

(6) Payment

Payment for the tour can be made by bank transfer. For payments by credit card, there will be an additional charge to cover the administrative fee. You are required to pay all bank transfer fees or administrative fees, if any. These fees are non-refundable should you decided to withdraw from the tour or if we cancel the tour.

(7) Amendment to Booking

Any change to your booking such as a change of name of traveller and/or designated departure date shall be deemed a cancellation of the tour and a cancellation fee will apply. You are required to submit a written request for an amendment. You shall pay for an administrative fee of S$75.00 per person in addition to the cancellation fee.

We will endeavour to accommodate or facilitate your request but cannot assure you that it can be effected. Where the change is possible, you shall be responsible for all additional charges that may be incurred to effect the change.

(8) Cancellation by Customer

You may cancel your booking, in writing, at any time before the designated departure date. We shall not be held liable for any contingent costs incurred by you arising from the cancellation. You shall pay the relevant cancellation fees set out as follows:

You will be notified of the amount of the cancellation fee payable as soon as possible following cancellation of your booking. Should the deposit be insufficient to meet the cancellation fee, you must settle the shortfall within 3 days of such notification.

(9) Cancellation by Company

We reserve the right to cancel any tour prior to departure for any reason whatsoever, including, but not limited to there being, in our sole and absolute discretion, security reasons, an insufficient number of registrants, passengers or participants. In such instance, we may in our sole and absolute discretion, recommend an alternative tour to the same destination with or without adjustment in price. Should you decide not to accept such alternative, we shall use best endeavours to refund to you, payments received from you, free from interest, free from bank and credit card administrative fees, free from deposits withheld by airlines, appointed agents and third-party service providers, without any further or other obligations, any compensation or any liability whatsoever to you.

(10) Surcharges

We reserve the right to adjust the price of your tour due to government action, currency exchange rates, airline fuel surcharge and taxes (including but not limited to airport taxes, port taxes and local taxes).

(11) Refund Policy

You shall not be entitled to any refund of any amount paid in the event that you cancel your booking, or if for any reason whatsoever your visa application is rejected by any authority or you are deported or cannot or elect not to commence or continue with the tour for any reason whatsoever or if you do not, in part of in full, use or participate in any accommodation, meal, tour or any other service which is included in the price of your tour.

(12) Travel Insurance

You are strongly encouraged to take out a suitable comprehensive travel insurance policy to cover any unforeseen circumstances such baggage loss, flight delays, medical emergencies and travel agent insolvency. You are wholly responsible for arranging your own insurance at your own expense. You should ensure that there are no exclusion clauses limiting protection for the type of activities in your tour. We shall not be responsible, under any circumstances, for any such matter.

(13) Passports and Vaccinations

You must ensure that you possess a passport or other travel document with a minimum of 7 months validity from/on the date of tour departure. You shall have the relevant visas, vaccinations, health certificates and/or other approvals as required by the relevant government authorities of the countries to be visited.

(14) Visas

You are responsible to apply for a pre-arrival visa on your own, if applicable. Different embassies or consulates have their own procedures to process visa applications. You are strongly advised to find out more details with the relevant embassies or consulates regarding your own visa application and/or requirements.

If your booking has to be cancelled because you are unable to obtain a visa or other travel document required, the relevant cancellation fee under Clause 8 will apply.

We shall not be responsible, under any circumstances, for any loss, damage or expense, or to reimburse or refund any part of the tour fare, should you be deported or refused entry by the immigration authorities of any country, for any reason, including irregular travel documents, quarantine restrictions, custom regulations, import/export restrictions, executive or administrative orders, possession of unlawful items or other criminal activities.

We may in our sole and absolute discretion assist in the group visa application for a fee but do not guarantee the outcome or approval of such visa application.

(15) Behaviour

You are expected to observe proper behaviour and conduct throughout the tour and to respect the customs (including dietary practices) and traditions of the countries of visit and the people therein. You shall be punctual, attend and participate in all tour activities. You shall comply with all directions of the tour guide and/or any tour leader, including but not limited to rotating coach seating arrangements during the period of the tour. By signing up for tours conducted by churches or Christians leaders, you understand that it is a Christian pilgrimage and you will honour Biblical, Christian or traditional standards of morality and ethics at all times.

(16) Restriction on roommates and visitors

We will not accept any reservation for twin-sharing if the couple is unmarried. Throughout the tour, you shall not permit any person of the opposite sex to visit you while alone in your room. You agree to accept the authority and decision of your tour leader in the event of dispute arising from sharing the same hotel room. You may be asked to transfer to a single room occupancy for the remaining part of the tour and the hotel’s daily walk-in rate will be chargeable. We will not be liable to pay any compensation whatsoever to you.

(17) Right to change itinerary

We reserve the sole and absolute discretion to alter any route, itinerary and/or accommodation for any reason whatsoever and on such terms as it in its sole and absolute discretion deems fit without prior notice to any customers.

(18) Extensions of stay or deviations

Any request for an extension of stay or deviation from the tour itinerary must be in writing and may be permitted, subject to applicable validity periods, restrictions on air tickets or seat confirmation, and availability of accommodation.

We will endeavour to accommodate your request but cannot assure you that it can or will be effected. Any extension or deviation will be at your own expense and separate transfers to and from the airport will not be included. All extra costs incurred to process the request for an extension of stay or deviation will be borne by you.

(19) Accommodation

Accommodation is usually based on sharing twin-bedded or double-bedded rooms at the nominated or similar standard hotels. While we endeavour to arrange accommodation based on the type of room and bed type requested, we shall not be responsible or liable if such cannot be provided by the relevant agent or hotel. We reserve the right to change the accommodation to a similar class hotel should the need arise.

For those booking triple-share rooms, the third bed may be a sofa doubled up as a bed in a standard twin sharing bedroom. Extra beds may be requested at additional cost to be advised and subject to availability at the relevant hotel.

For single customer who requests to be matched with a roommate, we will only match based on same gender and this is subject to availability. Should this matching not be successful, the single customer will need to pay for the single room surcharge. Once a roommate is matched and confirmed by us, no further changes are permitted. Should any party wish to change to a single room after the commencement of the tour, the hotel’s daily walk-in rate will be chargeable.

(20) Baggage

You will be allowed check-in and cabin baggage according to the respective airlines’ regulations. Your check-in and cabin baggage may also be subjected to security measures mandated by the relevant authorities. If your baggage exceeds the maximum permitted baggage allowance, you must pay the applicable additional baggage charges. We will not be responsible for the loss, damage or theft of any items belonging to a traveller throughout the tour.

(21) Meals

Meals are as specified in the itinerary. No refunds or replacements will be provided if the on-board meals are not served for any reason whatsoever.

(22) Mileage accrual

We will not be responsible for any mileage accrual for any frequent flyer membership programmes.

(23) Special requests

You are responsible to inform us of any special request that you may have, such as special on-board dietary requirements, special seating arrangements, requests for adjoining rooms, and others at the time of booking. All requests are subject to availability and confirmation, and we will not be responsible if any such request is not or cannot be met for any reason.

(24) Validity of pricing

All information and prices shown are accurate at the time of print.

The tour price includes airfare, accommodation, meals and sightseeing as specified in the tour itinerary.

Unless otherwise stated, the tour price does not include fuel surcharges and airport taxes as specified by the airlines and airport authorities, pre/post tour accommodation, room service, bar, beverage, laundry, Internet and telephone charges, porterage, tips, unspecified meals or tours, excess baggage charges, passport and visa fees, personal and baggage insurance, travel and medical insurance, and all other costs, fees or charges of a personal nature.

(25) Pregnancy

If you are pregnant, you are responsible to ensure that you have a doctor’s certification that you are fit for travel. Notwithstanding any such doctor’s certificate, third party providers (such as airlines or cruise companies) have the sole discretion to disallow a pregnant traveller to board the relevant flight or cruise or to undertake certain activities and no refund shall be payable in such event.

(26) Unfit to travel

In the event you are certified to be unfit for travel by a medical professional, we reserve the right to withdraw you from any tour which occurs during the duration which you are declared to be unfit for travel. In such instance, you shall not be entitled to any refund of any amount paid.

(27) Your indemnity to the Company

You agree to fully indemnify us forthwith upon request from and against all actions, proceedings, claims and demands whatsoever which may be instituted or made against us, including but not limited to those for damages, other relief, interest (as well after as before any judgment), costs (on an indemnity basis) and expenses whatsoever and howsoever directly or indirectly occurring to, suffered or sustained by or relating to any person, entity, authority or property wheresoever situated, as a result of any act or omission (whether negligent or not) of yours during or in connection with the tour.

(28) Responsibility and liability

You participate at your own risk of loss or injury to person and belongings. We shall not be responsible or liable for any loss, damage, expense, injury or death whatsoever including but not limited to such arising, occurring, suffered or sustained directly or indirectly from any of the following during or in connection with the tour: (a) any delay, accident, mechanical or electrical breakdown, sickness, weather condition, strike, crime, illegal act or omission, act of hostility, terrorism, conflict, war, quarantine or natural disasters; or (b) any denial of services by air carriers or coach, or in the event you are deported or refused entry to any country or place by any immigration or other authority or for and on behalf of any entity for any reason whatsoever; or (c) any act, omission, default or neglect of the Company whatsoever.

We reserve the right to withdraw any itinerary or any reservation made and/or to politely decline or refuse any individual as a member of the tour should the individual be deemed incompatible with the group and/or as instructed by the tour organizer. We will not be responsible for the care of infants, children, elderly and handicapped participants.

We are only acting as an agent and will not be held responsible for any changes, acts of discretion or inconvenience caused by the airlines, appointed agents and third-party service providers. In no case shall the Company or their employees or agents be liable for any causes outside their reasonable control or from any act of omission of the customer.

(29) Data Protection and Use of Personal Data

We respect your privacy and will make the necessary security arrangements to safeguard your personal information. It is our practice not to ask for information unless we need and / or intend to use it. The primary purpose for collecting your personal information is to provide and deliver our products and services to you (including services for the tour you have signed up for); improving our services and to conduct research and analysis and advertising and marketing our products and services (“the purposes”).

The types of personal information that we collect includes but is not limited to; your name, home and email addresses, home /office and handphone numbers; date of birth, gender, passport number and details, marital status, occupation, nationality, and other information necessary to fulfil specific travel and tour related purposes (such as booking of airlines and accommodations, submission for visa entry into the country of destination, emergency contact purposes etc.)

When you provide us with personal information for the purpose of receiving any form of assistance from us, we will collect, use and/or disclose such personal information solely to facilitate providing such assistance. Personal data collected will not be given to third parties unless it is necessary to fulfil the purposes set out herein (for example we will need to share your personal information to vendors including airlines, land operators and hotels). We will use its best endeavours to ensure that these third parties are also under similar obligations to protect your personal information.

We may amend this Privacy Policy from time to time. This Privacy Policy is not intended to, nor does it create, any contractual rights whatsoever or any other legal rights, nor does it create any obligations on us in respect of any other party or on behalf of any party. (30) Severability

Any term or condition herein which is or may become invalid, unenforceable, prohibited, unlawful or void in any respect under any law shall be ineffective to the extent only of such invalidity, unenforceability, prohibition, unlawfulness or voidness and without invalidating the rest of the said term or condition or the other terms and conditions herein.

(31) Governing law

These terms and conditions shall be governed and construed in accordance with Singapore law, and each of the parties submits itself to the non-exclusive jurisdiction of the courts of the Republic of Singapore.
